2) We file the Offer in Compromise with the Appeals Division in a Collection Due Process Hearing.
The hearing will usually be better for you. They approve a lot of Offers in Compromise. They're more realistic and they're cheaper.
It may seem illogical to go to the Appeals Division with Offers in Compromise rather than starting with a revenue officer. But there's a big difference between the two:
The revenue officers are there to collect money. They're not there to be your friend, no matter how polite they may be while dealing with you.
Appeal officers are an independent arm of the IRS. They're not there to collect money.
The hearing process
When you get a notice for a due process hearing, we file a request for a hearing, and two or three months later you get a hearing-a conference-with the Appeals Division.
If negotiation at the due process hearing does not resolve it, you can go to the Tax Court, and contest the collection determination.
The ideal outcome: You don't owe any money.
The next best outcome: you owe money, and you submit an Offer in Compromise, for less than the amount the IRS says you owe.
The entire Offer in Compromise process takes about nine months.
